Terms of Service

Last updated

These terms form an agreement between you and Unhandled ("we") for the use of Unhandled, a hosted service that receives, stores and displays telemetry from your software. By creating an account or sending data to the service you accept them on behalf of yourself or the organization you represent.

1. Accounts

You need an account to use the service. Keep your credentials, passkeys, API keys and DSNs confidential. You are responsible for activity under your organization, including actions taken by members you invite and by MCP clients you authorize.

Organization admins control membership, team access and billing. If you create an organization for an employer, you confirm you may bind it to these terms.

2. Plans, trials and payment

Paid plans are billed in advance, monthly or yearly, at the prices shown on the pricing page when you subscribe. Data sent above your plan allowance is charged per GB at the rate of your plan for the billing period in which it was received.

A new organization starts with a free trial. When the trial ends without a subscription we may stop accepting telemetry for it. Fees are non-refundable except where the law requires otherwise.

We may change prices with at least 30 days notice. A change applies from your next billing period.

3. Your data

You keep all rights in the telemetry, configuration and content you send to or create in the service ("Customer Data"). You grant us the rights needed to host, process and display it to provide the service to you.

You decide what your applications send. Do not send special categories of personal data, payment card numbers or secrets. Where Customer Data includes personal data, the Data Processing Agreement applies.

We keep Customer Data for the retention period of your plan and then delete it. When you close an organization we delete its data within 30 days, except where the law requires us to keep it.

4. Acceptable use

Do not use the service to break the law, infringe the rights of others, probe or overload systems you do not own, or attempt to access data belonging to other organizations. Uptime monitors must target endpoints you are allowed to test.

We may suspend an organization that puts the service or other customers at risk. Where practical we will tell you first and give you a chance to fix the problem.

5. Availability and support

We aim to keep the service available and to fix problems promptly, but we provide it without a guaranteed uptime unless a separate written agreement says otherwise. Planned maintenance is announced in advance where possible.

6. Disclaimers and liability

The service is provided "as is". To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Neither party is liable for indirect or consequential losses, or for lost profits, revenue or data. Each party’s total liability under these terms is limited to the fees paid by you in the 12 months before the claim. These limits do not apply where the law does not permit them.

7. Ending the agreement

You can cancel at any time from the billing settings. Cancellation takes effect at the end of the current billing period. We may end the agreement for material breach that is not fixed within 30 days of notice.

8. Changes and governing law

We may update these terms. For material changes we will give notice by email or in the app at least 30 days before they apply.

These terms are governed by the laws of [jurisdiction]. Questions go to [legal contact email].
